1. Application of these terms
These terms and conditions shall apply in respect of all goods and services we supply to you whether specified in the agreement, booked through our website, platforms or otherwise.
Except to the extent that these terms and conditions are varied by mutual consent they shall constitute the entire agreement between us.
2. Website Use & Working Together
Our website works as the backbone of our operation and has been designed to aid in our customer service.
From the website you are able to:
- Book a job and manage a booking once made
- Check the weather for when you are hoping to book – This can be found on the Book Now Page.
- Submit changes and requests which once submitted are added to our editor’s job board automatically. This greatly saves time on the changes.
- Find and Download any work we have done for you.
- Submit Special Job Briefs and Relevant information
- Check our pricing and packages
The more familiar you can be with this the higher quality our performance is able to be.
3. Delivery Times
We consider the service we provide to be art and with this does come variation to the time a job will take to film, edit and process.
In all cases of real estate bookings (pre-defined packages on our website) we aim to deliver:
Photos & Floor Plans – by 1.00pm the next day.
Boundary Lines and Location Pins – by 3.00pm of the next day.
Videos – by the End of the Day on the 2nd Business Day (48 hours).
Brand Work & Custom Concepts – by the End of the Day on the 4th Business Day (96 hours).
With Summer dusk timing and shots that go overtime, we will do our best endeavours to however hitting these delivery times is not guaranteed.
4. Photo & Video Deliverables
Unless discussed prior, the deliverables will match the deliverables displayed on the website for the service that was booked.
If there are further things asked which are not part of the original package then you will be charged with production (photo and video) to be charged at $150 per hour and editing to be charged at a rate of $80 per hour. Any work that is decided on-site and results in a variation to the original brief will be charged at this rate.
5. Booking & Expectations
We work on a first in first-served basis. Our system is designed to make this fair and for you to guarantee the team you normally work with you are able to check their availability using the Book Now page.
It is a great idea to use this prior to speaking with Vendors as it means you are able to secure the time that works for all. This will also mean you can have the same shooter every time you book.
We have two types of teams; full-time staff and contractor team.
The full-time team work from Monday – Friday, 9am – 5pm and outside of these hours they reserve the right to decide if they want to shoot outside of these times. This is so our team’s morale is high and they can balance life and hobbies.
The Contractor team have more flexibility with shooting times and their availability can always be found on the website. We require contractors to give us 16 working days each month.
6. Rescheduling and Cancelations
We use our best endeavours to provide a high level of production and with this being the focus there are things that need to be and stay the sole responsibility of the Agent or Booking Manager.
We will send a reminder 48 hours before a shoot is scheduled which is your opportunity to get in touch with the team if there are concerns or changes.
Outside of 24 hours before the shoot time, all bookings can be managed directly by the Agent or Booking Manager by logging into the booking page or by emailing hello@buildvision.co.nz.
Book Online
Where a shoot is to be rescheduled or cancelled by the client within 24 hours but could go ahead at no fault of our own a fee will be charged for the coordination of people, equipment, location and all other relevant fees that may be incurred as well as the opportunity cost of the time. This fee will be $150 + any hard costs the business entails.
7. Weather
We understand that this can change quickly and we aim to only shoot in good weather. Where a booking is made and the weather is not suitable on the day then there will be no reshoot fee.
If we are asked to go ahead and it starts raining at the time of the shoot we will return to capture the remaining shots at a cost of $150inc. This is to cover the time and costs associated with a second visit.
We use Windy as a rain and cloud radar and this can be seen on the Book Now page of the website or platform.

8. Moving things on the property
We aim to show complete respect any for property. For this reason, unless discussed prior, we do not permit our team to move couches, beds or other furniture or to declutter spaces without either an agent or approved party present.
Having the property ready for the shoot is the sole responsibility of the Agent or Booking Manager as we often do not see a property before shoot day.
A revisit that is the result of a property not being ready will be charged $150inc.
9. Changes to Pre-Productions and Post-Productions
We are happy to make all changes possible, however, It is very important for our operation that we only make a single round of changes to any of our productions for the original agreed price. Further rounds are charged at $80 per hour with a minimum of 1 hour charged in all cases.
Changes to the brief or otherwise that result in additional work being carried out will be chargeable at the $80inc per hour rate.
This shall include the following:
a. Changes that result from inaccurate on misleading information having been supplied by you in preparation of the brief;
b. Changes that result from your failure to obtain consent from any third parties or employees necessary in the delivery of the Service;
c. Changes that result from a significant change to the brief;
d. Additions to the original brief in the form of extra variations or edits of the originally booked service such as a new storyline, locations not previously discussed, shorter ‘highlights’ edits or specific web versions that are not agreed at the outset.
e. The failure to deliver instructions or assets before the work has commenced.
f. Extra changes after the first round has been completed.
Changes are to be submitted through the form that can be found at https://buildvision.co.nz/changes-requests/ and will be actioned within 12 hours of the submission.
10. Reshoots
A $150inc in reshoot fee may apply if a reshoot is required due to factors outside of our control. e.g. changes to the property, additions, a car or object blocking the property etc.
This fee is valid for a period of 7 days following the delivery of the project with all future shoots being full price.
11. Dissatisfaction
Although this does not happen often, if you are unhappy with the photos, video or service, please contact hello@buildvision.co.nz and we’ll resolve the issue for you as soon as possible.
We will always try our best to accommodate any changes you have requested.
The client’s payments cover/pays for the labour and presentation in the production of the agreed service. While every effort is taken by BuildVision to provide the client with the agreed product and dissatisfaction with its contents, although regrettable, will be deemed subjective and is therefore not open for interpretation by the client as grounds for refunds or compensation.
12. Payment Terms
All Real Estate work booked on behalf of the property is to be paid on the 20th of the month following the completion of the work.
All other work unless arranged prior is to be made within 7 days of the work being delivered.
If you are a new client with no previous payment history we may request a deposit for work prior to the shoot date or payment to be made within 7 days of the project being delivered.
We reserve the right to charge 10% interest per month on any unpaid balances not in dispute to cover the manpower, interest, and other costs we incur for carrying overdue invoices.
The first increase will be seven days after the invoice is due, with each increase being incurred on the 30th day following the first increase. Any fees incurred by us in recovering payment will be chargeable.
Once deliverables have been used for their purpose they are deemed accepted and the client becomes liable for the full amount owed.
13. Ownership of Original Material (Raw Footage)
Unless agreed to prior all proposals, quotes or packages are for the final productions only. All original recordings, Raw photographs, video files, measurements and edited or unedited computer files will remain the property of Build Vision.
Although original Raw footage is not part of the supplied product it can be provided for a rate of $259 (inc GST) per hour that the shooter or creator is on site.
If the situation arises where the service cannot be completed the Raw footage may be supplied as compensation.
14. Copyright
We operate a fair approach to copyright. All copyright vested in the final product by us shall be assigned to you subject to the following:
a. Payment in full is received from you for all outstanding invoices;
b. You grant us a royalty-free licence to use all copyright in the media produced by us for our own promotional purposes such as on our website, social media or otherwise;
c. All design concepts such as logos, themes, plans, and models together with all copyright in any music shall remain vested in us and shall be made available to you on licence save that you shall only be permitted to use such material and design concepts for the purpose identified in the brief.
15. Storage
All media produced by us on your behalf will be stored as follows:
a. All footage will be captured in High-Definition (as standard) and stored in professional format digital media storage for a period of 12 months.
b. Following the completion of a beta edit, the footage is then copied to a secondary backup hard drive at our studio to protect against electronic drive failure.
c. After 12 months from the completion date all footage will be the sole liability of the client and we can not be held accountable for any loss of data.
16. Safety of the Team
We reserve the right to cease filming or editing if situations arise that are unfit to continue, eg. grounds of safety, mistreatment, offensive or abusive behaviour, or unacceptable working conditions.
In these instances, the client is not liable for a refund or compensation.
